STRATEGIC DIVORCE THINKING
As our divorce lawyers and family law attorneys help you keep control of your divorce, one of the greatest attributes we can encourage in our clients is the importance of thinking strategically. The Probate and Family Court Judges, opposing counsel, and the majority of our clients hear us emphasize the application of a cost-benefit analysis.
In divorce, it is easy to get caught up in the emotion and make all decisions from that vantage point. Emotional decision-making can be a costly mistake; after all, to spend an hour arguing over one of the children’s nightstands could cost in excess of $500 in legal fees, not to mention time that each of you could have spent doing something more productive. From a rational standpoint, a new nightstand may cost less than $200 making the entire argument expensive and counter-productive.
Anytime you and your spouse are getting into a heated discussion relating to an aspect of your divorce, stop and ask yourself these four questions:
- How much is this issue worth to me in today’s dollars?
- Am I making an issue out of this just to spite my spouse (even though it isn’t a big deal to me)?
- How likely is it that I will end-up prevailing on this issue if I take it to a Judge?
- What will it cost to argue the point?
Several methods exist to handle divorce. The most common is litigation. This path takes you into the courtroom, where a Judge makes the final decision about your needs and your future.
Our attorneys from The Massachusetts Family Law Group can stand by your side as you go down this path, aggressively representing for your needs and interests.
We can also assist you with uncontested divorce matters – an alternative to courtroom litigation – where you work out an agreement with your former spouse. This process puts you, not a Judge, in control of the important decisions in your life.
